eBay Is A Lawsuit Magnet

LVMH Moët Hennessy has some good lawyers!

On Friday, a French court ruled that eBay is to pay the luxe megabrand $117,820 in damages for allowing key word searches for Givenchy, Christian Dior, Guerlain, and Kenzo perfumes without permission and failing to prevent sales of counterfeit fragrances.

This isn't the first time eBay has lost to LVMH in court. This past June, the auction website paid $55.7 million for allowing sales of counterfeit LVMH products at large.

What's more, LVMH is not the first brand to take issue with eBay's laissez-faire attitude. In June 2008, the e-commerce site had to pay Hermès $31,058 for permitting sales of counterfeits.

eBay isn't always the legal loser, though. This past July, Tiffany & Co. sued eBay over counterfeit jewels, but a U.S. court ruled that the online auction isn't legally responsible for precluding sales of counterfeit goods. Similarly, when L'Oréal sued eBay this past May, the Paris High Court ruled that eBay is not to be blamed for the sale of faux beauty products.

Sounds like LVMH and Hermès are in the hands of better attorneys!
