
Clothing retailer New York & Co is suing J.C. Penney and their advertising agency Saatchi & Saatchi over a new campaign. According to the lawsuit, NY & Co claims J.C. Penney posted a billboard in Times Square in July to announce it's opening in Manhattan using the mark "NYC Style".
New York & Co has used "NY Style" in it's marketing since August 2008 and believe the use of JC Penney's "NYC Style" will confuse shoppers, especially "since the department store sells merchandise at lower prices than New York & Co."
Seriously? This is kind of ridiculous.
It's not like both stores are right next door to each other. Besides, we're pretty sure people are going to shop at either store based on preference not by some stupid New York ad campaign.
