A 61 year old lifeguard will finally get his day in court after he was fired back in 2007 for refusing to wear a Speedo.
Roy Lester says he was promptly fired after 40 years as a Jones Beach lifeguard because he wanted to wear his "jammers" for the speed test.
They told him no, so the bankruptcy lawyer filed an age discrimination lawsuit against the state of New York. Lester adds "It's not an attractive look".
