Remember when Louboutin waved their beautiful finger at YSL over a red sole? They claimed YSL was stepping on their toes by coloring a sole red, one of Louboutin's trademarks.
But of course, a district judge found the whole ordeal to be a silly mess. His main judgements were A) no company can have a monopoly on a single color, and B) YSL using a red sole wouldn't make Louboutin's red shoes any less fabulous.
Well, Louboutin wasn't satisfied with this so they filed an appeal. And now the lawyers for YSL have filed their response.
They insist the claims made by the opposing company are pish-posh and without real proof of "irreparable harm," the decision made by the smaller court should be good enough.
But Louboutin is confident in their new argument, which is to be heard in court January 24, saying:
We have taken a quick review [of the brief and], there are no surprises here. YSL essentially is mirroring the arguments it used at the lower level, which is entirely expected. We are pretty confident our brief is persuasive. Nonetheless, it remains the decision of the Court of Appeals at the end of the day.
